## The problem

The class alleges that pixels on Allina Health's websites sent patients' information to third parties. Allina denies the allegations ([Settlement FAQ](https://www.allinapixelsettlement.com/faqs/)). On 24 September 2026 the court granted final approval and entered judgment ([Final approval order, Doc. 68](https://law.justia.com/cases/federal/district-courts/minnesota/mndce/0:2024cv03674/220147/68/)).

## Case record

| Field | Record |
| --- | --- |
| Court | US District Court, D. Minnesota (Judge Susan Richard Nelson) |
| Case number | 0:24-cv-03674-SRN-ECW |
| Parties | Ahlers et al. v. Allina Health System |
| Laws | Not reviewed; complaint not opened |
| Stage | Final approval and judgment, 24 September 2026 |
| Amount | USD 12,500,000 settlement fund |
| Source review | 20 October 2026 |

## What was alleged

The court has not ruled on any claim. The settlement resolves allegations that pixel tracking on Allina's websites disclosed information about patients, and divides the class into two groups:

- **Group 1:** patients who used Allina's patient portal, bill-pay or online scheduling between 16 September 2018 and preliminary approval (May 2026). About 1,585,092 people.
- **Group 2:** other Allina patients in the class. About 946,231 people.

## Technical issue

- **Tools:** pixels on Allina's websites ([FAQ](https://www.allinapixelsettlement.com/faqs/)). The specific vendors are not named in the sources reviewed.
- **Where:** the settlement distinguishes portal, bill-pay and scheduling use from other site use.
- **When:** from 16 September 2018.

**Inth's technical interpretation:** the group split mirrors where the risk sits. Pages behind login, payment and scheduling flows carry identity and care details, so tags present there disclose more than tags on public pages. Keep advertising tags off authenticated and transactional flows entirely.

```javascript
// One tag container on every page, including portal and scheduling
fbq('init', '123456789012345');
fbq('track', 'PageView');
// Exclude authenticated and transactional paths, and require consent elsewhere
const sensitive = /^\/(mychart|portal|billpay|schedule)/.test(location.pathname);
if (!sensitive && consent.has('marketing')) {
  fbq('init', '123456789012345');
  fbq('track', 'PageView');
}
```

Illustrative pattern, not the defendant's code. Generic consent API, not a specific c15t call.

## Why it matters

- **Logged-in use is priced higher.** About 82% of the fund goes to portal, bill-pay and scheduling users, who are about 63% of the class.
- **Long look-back.** The class period starts in September 2018, years before suit.
- **Part of a pattern.** Health-system pixel cases continue to settle before rulings. Compare [Cone Health](/enforcement/cone-health), [Kaiser Permanente](/enforcement/kaiser-permanente) and [Novant Health](/enforcement/novant-health).

## How Inth catches this

- **Consent banner:** holds advertising pixels until their category is granted where the policy is opt-in. Consent does not make portal or scheduling activity appropriate for an ad pixel.
- **Website audit:** records requests to ad and analytics vendors from login, portal, bill-pay and scheduling entry pages, with page, time, region and consent state.
- **Evidence:** consent records with choice, country and policy, and per-page runtime observations.

Limit: Inth cannot see inside authenticated portals it is not given access to, or server-side transfers. Breach-notification questions are for your legal team.

## Checks for your own systems

### In the repository

- List tag-manager triggers that fire on all pages and add exclusions for portal, payment and scheduling paths.
- Check links into the portal for tags that fire during the redirect.

### In the browser and network

- Walk through bill-pay and appointment booking with test data and search third-party requests for that data.
- Check page URLs and titles sent to vendors for doctor, department or condition names.

### With the people responsible

- Confirm who owns tags on patient-facing flows run by vendors.
- Record when pixels were removed and keep the evidence.

## Sources and limits

The complaint, settlement agreement and preliminary approval order were not opened, so the claims pleaded, the vendors involved and any practice changes are not recorded here. The group allocations come from the settlement FAQ. Minnesota is not yet a value in the library's jurisdiction filter, so this draft has no typed jurisdiction.

Source review: 20 October 2026. This page describes the cited records and procedural stage. It does not audit Allina Health's current systems. Inth wrote the technical checks; they cannot decide which laws apply or prove compliance.
