Sling TV: check opt-outs on every device your customers use

You can check the opt-out inside the app that a customer uses. Sling TV’s 2025 case shows why a website form is not enough.

The announcement described a proposed settlement. The DOJ also publishes the judgment, which records agreed terms without a trial or an admission of liability. Judgment, page 2

What happened

The DOJ alleged that Sling TV made opt-outs hard to find and complete. It also alleged gaps in privacy protections for children. DOJ announcement

The settlement sets USD 530,000 in civil penalties. Its terms cover in-app opt-outs, simpler forms for logged-in customers, and children’s profiles that limit data use. Judgment, paragraphs 22–42

Technical behaviour

The DOJ said that cookie choices did not complete the CCPA opt-out. Logged-in customers still faced a form for information that Sling TV already held. Some apps on living-room devices lacked an opt-out method. DOJ announcement

Inth’s technical interpretation: a cookie choice and a statutory opt-out can control different data flows. Tests need to cover each app, device, and account state.

Checks for your own systems

  • Compare the result with the website choice.
  • Check data transfers after the choice and a return visit.
  • Use invented profiles to test the controls for children.

With the people responsible for data use
